Please read these terms and conditions carefully before using the services offered on the www.aidemobi.com site. These GCS define the conditions and legal obligations related to the subscription of the services present on the website accessible at the address www.aidemobi.com offered by the company Cospex Limited. The customer is informed that he benefits from a satisfied or refunded offer on the site in accordance with the provisions of article 9 hereof.

2. GENERAL

These General Conditions of Sale define the terms of access to the Website www.aidemobi.com and the services marketed and distributed by Aidemobi.com (hereinafter the "Services") to its customers for their personal use (hereinafter referred to as the "Client"), as well as the rights and obligations of the parties arising from the online subscription. By subscribing to a Service on the Site, the Customer acknowledges having read these General Conditions of Sale and having accepted them without restriction or reservation. Given the electronic nature of the contract between the Client and Aidemobi.com, this acceptance is in no way conditional on a handwritten signature on the part of the Client. Any written document and/or any other specific condition contained in particular in documents issued by the Customer (including the order) cannot prevail over these General Conditions of Sale without the express prior written agreement of Aidemobi.com. The version of the General Terms and Conditions of Sale available online on the Site will prevail, where applicable, over any other version of these General Terms and Conditions of Sale, with the exception of modifications that may have occurred after an order has been placed and this, in accordance with common law. . In case of contradiction between the terms of the General Conditions of Sale and the Order Form, the contractual provisions of a higher rank will prevail over those of the lower rank in the following order:

  • The General Conditions of Sale;
  • The Order Form.
  • All of these contractual documents are referred to below as the “contract”.

3. SERVICES

3.1 Description of services

Aidemobi.com present on the Site, the Services, as well as their detailed descriptions contained in the sheets corresponding to each Service. Thus allowing the Customer to know, before the final validation of his order, the essential characteristics of the Services he wishes to buy. Aidemobi.com will also make its best efforts to best define the characteristics of the Services offered to the Client.

3.2 Service prices

The applicable prices are those indicated on the Site at the time the Customer validates his order. The prices are indicated in EURO and include all taxes. The prices are subject to local taxes and any change in the legal rate of these taxes will be passed on to the price of the Services presented on the Site, on the date stipulated by the implementing decree relating thereto. At any time and without notice, Aidemobi.com reserves the right to modify its prices. These changes will not, however, affect orders that Aidemobi.com would have accepted before these changes took effect. In addition, Aidemobi.com reserves the right to allow the Customer to benefit from promotional offers and price reductions, which will be effective the month following their implementation.

4. ORDERING SERVICES

4.1. Order a service

By browsing the Site, the Customer has the opportunity to freely learn about the various Services offered for sale on the day of consultation of the Site. The Customer has the possibility, at any time of the order process, namely until the actual payment of the latter under the conditions provided for in paragraph 4.3 below, to return to this order in order to complete, modify, or even cancel. Once the selection of the Services is complete, the Customer will be invited by a new Internet page to communicate his contact details by accurately filling in the Order Form made available to him. As such, the Customer formally undertakes to provide a valid and functional email address and not constituting the offense of identity theft. In the event of false and/or misleading provision of the email address by the Customer, Aidemobi.com reserves the right to cancel the order without delay and without the Customer being able to claim any compensation. Once the Order Form has been completed, the Customer will be invited by a new Internet page to communicate his payment information under the conditions provided for in paragraph 4.3 below. As soon as the payment information is communicated, the Customer will be invited to click on the Validate" button in order to proceed with the payment of his order and test the Mobitech+ offer for 48 hours by clicking on the "Validate" button during the ordering process, the Customer must obligatorily take note of these General Conditions of Sale and declare “to have read and accepted fully and without reservation the entirety of these General Conditions of Sale”."


4.2. Identifier Codes – Uses – Responsibility

As soon as the Order Form is validated, Aidemobi.com will assign the Customer his Identifier Codes, i.e. an Identifier (Login) and a Password. The Customer acknowledges that these Login and Password constitute the only means of validating the Customer's access to the Services and to the online Admin, to the exclusion of any other means. The whole constitutes its “Identifying Codes”. The Customer is informed of the need to provide a valid email address in order to receive an email confirming the creation of said account. The Customer is required to always update his Personal Information by following the procedures provided by Aidemobi.com . If the data provided proves to be inaccurate, incomplete or misleading, Aidemobi.com reserves the right:

  • not to activate and/or suspend the Service until the Customer corrects his errors,
  • to terminate the Contract(s) as of right in the event of failure to update it by the Customer within the required timeframe, without the Customer being able to claim any refund, credit note or compensation.

The same applies in the event that the competent bodies (eg banks or credit/bank card holders) dispute the payments made by the Customer. Each Customer acknowledges his entire responsibility in the use that will be made of his identifying Codes as well as of the Site. He undertakes to maintain and keep these Identification Codes strictly confidential, not to disclose them to third parties, even temporarily, in any form whatsoever and to use them only for strictly personal purposes. In the event of forgetfulness, misuse or unauthorized use of its identifying Codes by another Customer, the responsibility of Aidemobi.com can in no way be engaged and the Customer must immediately inform Aidemobi.com of this situation, by a message on the contact page. After receipt of this duly justified written notification, Aidemobi.com will study the file and may, for security reasons, suspend all access to the admin. Aidemobi.com will process the Client's request as soon as possible and send him the new Identifier Codes by email after verification of his identity. The Customer remains responsible for the use of the Service by third parties until the modification by Aidemobi.com of the Identifying Codes, thus the Customer guarantees Aidemobi.com from any action or claim concerning the loss of data resulting from the loss or fraudulent use of its Identifying Codes. The modification of all or part of the Customer's Identification Codes will give rise, where applicable, to invoicing, without modification of these on the initiative of Aidemobi.com. In accordance with article 10.5 of the GCS, the Customer has a right to access, modify, rectify and delete data concerning him.


4.3. Payment for service

The payment of the order is made on the Internet and must be concomitant with it, according to the instructions given for this purpose during the process of validation of the order. Payment will be made in EURO by electronic payment system. Aidemobi.com uses a secure payment tool and guarantees the Customer that he never has access to confidential information relating to the means of payment used by the latter to pay for his order. In order to make the payment due, the Customer will be asked to provide the bank card number, the expiry date of the latter accompanied, if necessary, by the visual cryptogram. To optimize the security and authentication of the electronic payment made by the Customer, Aidemobi.com has set up the SSL" protection system for each payment made on the Site. The Customer is invited to follow the authentication procedure set up for this purpose. Otherwise, the payment will be canceled and the Customer will not be able to receive the Services ordered. The Customer's bank details are requested for each order insofar as only the bank chosen by Aidemobi.com for carrying out this financial transaction remains in possession of the confidential information. To this end, the Customer guarantees Aidemobi.com that he has the necessary authorizations to use the method of payment chosen at the time of validation of the order and that this bank card gives access to sufficient funds to cover all the costs resulting payment on the site of Aidemobi.com . Once the payment of an order has been executed, a summary of the Customer's order will be displayed and will mention in particular the order references. The data recorded by Aidemobi.com constitutes proof of all transactions between Aidemobi.com and the Client. Aidemobi.com informs the Client that bank charges are invoiced by his banking establishment for each Service subscription on the Site."


4.4. Confirmation of the order by Aidemobi.com

The order will only be considered firm and final once confirmed by Aidemobi.com to the Customer after receipt of payment. Aidemobi.com reserves the right to refuse any order or any access to the Service in the event of an existing dispute with the Customer following in particular the non-compliance by the Customer with the obligations subscribed to under the terms of these General Conditions of Sale, in particular with regard to concerns any incident of payment of the price of an order, likely to lead to the suspension of access to the Site of Aidemobi.com, or even the termination of this Contract without prejudice to any damages that Aidemobi.com may request. Following the payment of the order, the confirmation of Aidemobi.com occurs as soon as possible by e-mail. This order confirmation email sent by Aidemobi.com will include the following information:

  • The order reference determined by Aidemobi.com at the time of its validation by the Customer
  • The summary of the order (designation of the Service(s) ordered, quantity, price)
  • The total amount of the order, all taxes included
  • Confirmation of payment
  • The terms and conditions relating to access to the Service ordered.

4.5. Availability of Services

The Services distributed online by Aidemobi.com are those that appear on the Site, on the day the Customer consults the Site and within the limits of their availability and the availability of the various service providers involved. In case of unavailability of a Service, Aidemobi.com will inform the Customer as soon as possible by e-mail of the availability of a partial order or the cancellation of his order. However, in the event of unavailability of the Service ordered by the Customer, Aidemobi.com may offer or deliver to the Customer a Service of equivalent quality and price. If the Customer's bank account has already been debited at the time of the aforementioned information to the Customer, Aidemobi.com undertakes to reimburse the Customer as soon as possible for the price of the Service unavailable on the bank account debited during the order. At any time, Aidemobi.com reserves the right to modify or no longer market the Services offered on the Site, these modifications however having no impact on the orders that Aidemobi.com would have accepted before the entry into force of these changes.

5. ACCESS TO ORDER SERVICES

Aidemobi.com retains control of the Customer's access to the Services ordered at all times until full payment of the price of the order. In the event of non-payment, Aidemobi.com reserves the right to suspend access to the Services ordered under the conditions of article 17.

6. GUARANTEES – LIABILITY

6.1. Internet user guarantees

By accessing the Aidemobi.com Website, the Internet user declares, guarantees and undertakes to:

  • access and use the Website and the services in good faith, in a reasonable manner, not contrary to the terms of these General Conditions and for strictly personal use and for non-profit purposes
  • not to use devices or software other than those provided by the Company intended for:

  • i) affect or attempt to affect the proper functioning of the Website and/or the services it contains
    ii) or to extract, modify, consult, even in buffer or temporary memory, or for individual use, all or part of the Website
  • not directly or indirectly market the services and/or access to the services and/or access to the Website; not to exploit the services provided by Aidemobi.com or the data to which it could.
  • have access via said services and/or the Website for direct or indirect commercial purposes and/or for personal purposes in a form and/or media not authorized by Aidemobi.com;
  • do not commit an act of hacking
  • not to access and/or use the Website and/or the services provided by the Company on said
  • not to use the Website for illicit purposes and/or with the aim of causing damage to the reputation and image of Aidemobi.com or more generally of infringing the rights, in particular intellectual property, of Aidemobi.com and /or third parties;
  • not to reuse all or part of the Website and the services it contains, in particular for commercial and/or collective and/or personal purposes in a form and/or media not authorized by the Company;
  • not to reproduce, represent all or part of the Website for private purposes beyond the legal exceptions provided for by intellectual property law, or with a view to direct or indirect marketing, in particular to third parties;
  • not limit access to and use of the Website and/or services;
  • not to use and/or exploit the electronic and/or postal contact details of others

In the event of a breach of one or other of these obligations and, without this list being exhaustive, the Internet user acknowledges and accepts that Aidemobi.com will have the option of refusing him, unilaterally and without prior notification, the access to all or part of the Website.


6.2. Guarantees of Aidemobi.com

The Internet user is solely responsible for the use he makes of the Website and the Services which he accesses from the Website. In this respect, given the evanescent nature of the content that may be disseminated there, Aidemobi.com cannot be held liable in the event that the content of said third-party websites contravenes the legal and/or regulatory provisions in force. In any event, Aidemobi.com cannot be held responsible:

  • in the event of unavailability of the Services for reasons such as failure of the public electricity network, failure of cable telecommunications networks, loss of connectivity to the Internet network due to public or private operators, in particular the Internet user, including the causes arise in particular from strikes, storms, earthquakes or any other cause having the characteristics of force majeure;
  • in the event of use of the services by a User under conditions that do not comply with the terms hereof; within the limits of the legislation in force, for any indirect damage and this included.

Aidemobi.com cannot be held responsible for any malfunction of any kind whatsoever relating to the computer equipment of the Internet user as well as to his Internet access connection, when accessing the Website and more generally the Services. More specifically, Aidemobi.com cannot guarantee the Internet User of the Services on:

  • Problems of access speeds and buffering of the Internet user's computer to the Websites of partners and/or affiliates,
  • Problems accessing services published by third parties affiliated with Aidemobi.com,
  • The quality of the texts, information, descriptions added to the services offered by third parties and accessible from the Website.

7. MOBITECH+ SERVICE

7.1 MEMBERSHIP AND REGISTRATION FOR THE SERVICE

When subscribing to the Mobitech+ Service, the Customer agrees to follow the instructions provided on the Aidemobi.com Website and to enter their Personal Information correctly, accurately and truthfully. The Customer is informed that the subscription procedure is done exclusively online, on the Aidemobi.com Site. The Client is informed of the need to provide a valid email address in order to receive an email confirming the creation of said account. The absence of confirmation by the Client of his Personal Information within the aforementioned period will be considered as a serious breach of the obligations of the Customer entailing the automatic termination of the Contract. The Customer is reminded that his express confirmation of his Personal Information will exempt Aidemobi.com from any responsibility for the data provided and confirmed by him. The Customer is required to always update his Personal Information by following the procedures provided by Aidemobi.com . If the data provided turns out to be inaccurate, incomplete or misleading, Aidemobi.com reserves the right:

  • not to activate and/or suspend the Service until the Customer corrects his errors,
  • to terminate the Contract(s) as of right in the event of failure to update it by the Customer within the required timeframe, without the Customer being able to claim any refund, credit note or compensation.

As soon as the Registration Form is validated, Aidemobi.com will assign the Customer his Identification Codes by email, i.e. an Identifier (Login) and a Password. The Client acknowledges that these Login and Password constitute the only means of validating the Client's access to the Services and to the online admin, to the exclusion of any other means. The Customer accepts that all acts carried out using the aforementioned Login and Password are considered to have been carried out automatically by the Customer himself and are authentic. The Customer accepts that the computer or electronic recordings made by Aidemobi.com and/or by its suppliers for the delivery of the Services, of all operations carried out in particular through its Admin, may be opposed or used before any administrative authority and/or or competent court as evidence. The Customer acknowledges being solely responsible for the acts carried out by means of his Login and Password. He undertakes to maintain and keep these Identification Codes strictly confidential, not to disclose them to third parties, even temporarily, in any form whatsoever and to use them only for strictly personal purposes. It is the Customer's responsibility in the event of loss, theft or any fraudulent act with regard to the Identifying Codes to inform Aidemobi.com as soon as possible by email and/or by registered letter with acknowledgment of receipt, and to justify of his identity by any means. Upon receipt of this duly justified written notification, Aidemobi.com will study the file and may, for security reasons, suspend all access to the Admin. Aidemobi.com will process the Client's request as soon as possible and send him the new Identifier Codes by email. The Customer remains responsible for the use of the Service by third parties until the modification by Aidemobi.com of the Identifying Codes, thus the Customer guarantees Aidemobi.com from any action or claim concerning the loss of data resulting from the loss or fraudulent use of its Identifying Codes.


7.2 Test offer for 48 hours

The Mobitech service test offer is billed € 1.00 for 48 hours, then €29 per month

As part of a Customer's order for a Service under the ordering procedure described in Article 4.1, Aidemobi.com offers the Customer the possibility of testing the Mobitech+ Service for a period of 48 hours from the validation of said order by the Customer. To benefit from this test offer for 48 hours, the Customer must pay Aidemobi.com the sum of € 1.00. Thus, the Customer has, for a period of 48 hours, a space allowing him to test the service offered by the company Aidemobi.com and accessible via the Website https://www.aidemobi.com/ using the identifiers which he are provided by Aidemobi.com under the conditions of article 4.2 hereof. At any time, the Customer has the choice to subscribe to the full version of the Mobitech+ Service subject to the trial, or not to subscribe to it. If the Customer decides not to subscribe to it, he must request the termination of his Subscription before the end of the 48-hour test offer period by contacting our customer service. Any termination request made after the expiry of the said 48-hour period will result in the automatic subscription of the Subscription for a period of 1 (one) month, renewable under the conditions of article 7.4 below. It is understood that subscription to the Mobitech+ Service by the Customer, including for its 48-hour test version, implies full acceptance of the terms hereof.


7.3 Verification of suitability as needed

The Customer hereby declares that he has proceeded prior to subscribing to the Security Guides Service to the verification of its adequacy which he deems adapted to his needs as well as having received from Aidemobi.com all the information and advice which were necessary for him to subscribe to this contract and that he therefore waives any dispute on this point. He further declares that he has the knowledge, skills and resources, in particular human and technical, required for the use of the Service.


7.4. Duration of Mobitech+ Service (excluding 48H test)

The duration of the Mobitech+ Service provided by Aidemobi.com to the Customer is that provided for in the Order Form or by default for a period of (1) one month from the expiry of the 48H test period as described in Article 7.2 hereof. The Mobitech+ Service is tacitly renewable for the same duration unless the Customer terminates his subscription under the conditions of article 17. The Customer is informed that the Mobitech+ Service will be automatically interrupted and canceled on the expiry date indicated in the Admin and by email mail, if it has not been duly settled before the expiration date. No payment will be refunded, even in the event of suspension, cancellation or transfer of Service before the end of the contractual period, except for specific provisions provided for below.


7.5. Description of the Mobitech+ offer

The Mobitech+ offer allows you to benefit

  • Assistance in using your mobile phone. This telephone assistance may be supplemented by sharing the customer's screen as support. On this occasion we will use the time of the consultation a screen sharing system which will make it possible to offer easier help.
  • A collection of eBooks on new technologies;
  • As well as sending unlimited geolocation requests

7.6. Amounts - Payment

The Mobitech+ offer entails a monthly debit from the Customer's bank account, entered during the ordering procedure as described in Article 4.3 for an amount provided for in the Order Form. This amount includes the fixed price of the subscription to the Mobitech+ Service described in article 7.5 above. This amount will thus be subject to one (1) bank debit every month. The Customer is informed that any partial or incomplete payment will prevent the provision of the Services offered by Aidemobi.com. Invoices will be available upon request. No payment will be subject to reimbursement, in the event of suspension, cancellation or transfer of the Service by the Customer or because of a fault committed by the latter in the performance of a contractual obligation to the title hereof before the end of the contractual period, except for specific provisions provided for herein.Aidemobi.com cannot be held responsible for any loss of Data, delay in processing the order, etc., or failure to comply with any of the provisions of this article could result.

8. USE OF THE SERVICES – CUSTOMER RESPONSIBILITY

Aidemobi.com is unable to guarantee the Customer continuous and permanent availability of the Service. Aidemobi.com however makes its best efforts to provide the Service, subject to maintenance periods. Aidemobi.com reserves the right to interrupt the Service for maintenance and/or improvement of the Service. These Service interruptions will, as far as Aidemobi.com can, be notified to the Client beforehand. In the event of an emergency, Aidemobi.com nevertheless reserves the right to suspend partially or totally, for a reasonable period, the Service to carry out any technical operation required. These interruptions of Service cannot give rise to any compensation in favor of the Customer. In the event of inaccessibility of the Service due to technical malfunctions under the responsibility of Aidemobi.com, Aidemobi.com will do its best to resolve this malfunction(s) as soon as possible from the written notification sent by the exclusive bias of the Admin, to Aidemobi.com provided that:

  • The Customer describes as precisely as possible the malfunctions observed,
  • Said malfunctions can be reproducible,
  • The Customer fully cooperates with Aidemobi.com,
  • Said malfunctions are not caused by improper use of the Service by the Customer.

Aidemobi.com declines all responsibility in the event of interruption and/or malfunctions of the Service due to:

  • the Customer's violation or non-compliance with any of his obligations under the GCS as well as the indications provided by Aidemobi.com;
  • the malfunction or inappropriate use of the means of access to the Service used by the Customer and/or the inappropriate use of the Service by the Customer;
  • force majeure events;
  • events dependent on acts of third parties such as, for example, the interruption or malfunction of the services of telecommunications operators and/or power lines or acts of omission or error by the Authority competent;
  • the malfunction of the terminals or other communication systems used by the Customer;
  • by the Client;

As an essential and determining condition of these terms and conditions, if the responsibility of Aidemobi.com were retained, the customer could not claim, to other indemnities and damages or any settlement, all causes combined, only to the penalties corresponding to the price of the subscription for the month during which the generating event took place, all damages combined. It is agreed that the provisions of this article engage both Aidemobi.com and any company that would come to control it as well as any company to which it would have transferred all or part of the rights and/or obligations of the Contract.

9. SATISFIED OR REIMBURSED OFFER – TERMS

10. IT AND FREEDOMS

10.1 Right of access

The Internet user has a right to access, modify, rectify and delete personal information collected by Aidemobi.com concerning him. To exercise this right, the Internet user can send a message to Aidemobi.com on the contact page. The Internet user may receive from Aidemobi.com and/or, where appropriate from its partners, e-mails providing information on the products, services and activities of Aidemobi.com. The Internet user retains the right to refuse such communication a posteriori, by expressing his refusal by e-mail. The personal data of Internet users of the Site are only collected, processed and used without any other prior express agreement insofar as this is necessary for the conclusion and proper performance of the contract as well as for invoicing purposes. In accordance with the law, Aidemobi.com is authorized to inform the competent authorities in the context of criminal proceedings.

The person responsible for processing the User's personal data is Aidemobi.com whose contact details are referred to in Article 1 of these General Conditions.

10.3 Controller

10.4 Purpose of processing

The User's personal data collected from him and processed by Aidemobi.com is intended to allow Aidemobi.com to:

  • establish general statistics on the traffic of its Website and the various sections it contains;
  • send by e-mail to the User information letters on the evolution of the Website and the various sections of the said Website;
  • transmit requests for information issued by the User to third party partners selected by Aidemobi.com to allow the proper execution of the Service order placed by the Customer.

10.5 Right of opposition of access, rectification and deletion of the Internet user

The User has, at any time, the ability to:

  • object to the processing of their personal data within the framework of the services provided by Aidemobi.com
  • oppose the communication of personal data concerning him to third parties;
  • access all of their personal data processed as part of the services provided by Aidemobi.com;
  • rectify, update and delete personal data processed as part of the services provided by Aidemobi.com.

Procedures for exercising his rights by the Internet user To exercise his rights, the Internet user simply has to send a simple letter, taking care to justify his identity (mention his surnames, first names, e-mail address and attach a copy of his identity document) to Aidemobi.com. Security and archiving of the Internet user's personal data Aidemobi.com collects and processes the User's personal data with the utmost confidentiality. Aidemobi.com undertakes to take all reasonable measures necessary to secure and protection of the personal data of Users of its Website and its services, collected and processed by it. All of the User's personal data are electronically archived by Aidemobi.com, for the duration of the User's registration on the Website and are deleted once their registration is terminated. .

11. SECURITY AND CRYPTOGRAPHY OF DATA

The Aidemobi.com site is subject to one of the most efficient security systems at present. It has not only adopted the SSL encryption process (Secure Socket Layer) but also reinforced all scrambling and encryption processes in order to protect all sensitive data related to means of payment as effectively as possible. The Customer is reminded that Aidemobi.com never has access to confidential information relating to the means of payment. This is why the Customer's bank details are requested for each Order. Indeed, only the payment platform has confidential information (card number, expiry date) which is inaccessible to a third party.

12. INTELLECTUAL PROPERTY

16. Dispute and reimbursement

18. GENERAL

18.1 Force majeure

Any event outside the control of Aidemobi.com and against which it could not reasonably protect itself constitutes a case of force majeure and as such suspends the obligations of the parties, such as for example, without this list being exhaustive: flooding , fire, storm, lack of raw materials, transport strike, partial or total strike, or lockout, technical failure (electricity supplier, telecommunications operators, Internet service providers or hosting, Registrar, etc.), an interruption in the supply of energy (such as electricity), a failure of the electronic communication network on which Aidemobi.com depends and/or the networks that would replace it.
